Planned Parenthood Arizona and Planned Parenthood Federation of America React to Court of Appeals Ruling That Provides Long-Sought Clarity That Abortion Remains Legal in Arizona

PHOENIX — Today, the state court of appeals issued a ruling in Planned Parenthood's case against AG Brnovich's efforts to allow enforcement of the state’s 1864 near-total abortion ban, including against licensed physicians.

Brittany Fonteno, President and CEO of Planned Parenthood Arizona, released the following statement: 

“Let me be crystal clear that today is a good day. The Arizona Court of Appeals has given us the clarity that Planned Parenthood Arizona has been seeking for months: when provided by licensed physicians in compliance with Arizona’s other laws and regulations, abortion through 15 weeks will remain legal. Stopping Attorney General Brnovich's efforts to impose a near-total abortion ban in the state has been a hard-fought victory, but we won’t be fooled, we know the work is not over.

After the overturning of Roe v. Wade, AG Brnovich and his extremist allies took it upon themselves to create chaos, rapidly shift the landscape for abortion access in Arizona, and deny their constituents basic health care. Through that chaos, Planned Parenthood Arizona fought for clarity in the face of insurmountable confusion. Today brings us one step closer to fundamental abortion rights for all Arizonans.”

“This is a monumental victory. For the past six months, Arizonans have lived in a state of confusion and uncertainty with the ongoing threat of this Civil War-era abortion ban. Today, patients and providers can finally breathe a sigh of relief.

There is no doubt that there will be more anti-abortion attacks in the coming months and years, but for now, the cruel and antiquated near-total abortion ban will not block Arizonans from maintaining control over their bodies, health care decisions, and futures.”
